That said Lego still owns what's in the image and can theoretically sue distributers for damages however 1) They wouldn't, and 2) I doubt they could even win the suit seeing how the internet works.
End of thought: There's nothing Lego can do about us talking about the leak. There's nothing illegal about it. We didn't sign anything. They can't sue us (well technically you can sue for anything but you get what I'm saying).
HOWEVER ideally leaked pictures wouldn't be shared here. It's the principal.
An example is if a movie or book is leaked early it's not illegal to talk about the contents. Take the leaks of that Harry Potter book where Snape kills the guy. That info and many books were sold early. There was absolutely nothing the company could do to the people who bought the books early or to the people spoiling the book for other people with the leaked info. HOWEVER they could go after the distributers who sold them early (like the leaker who leaked the Lego stuff but not the people who saw what he leaked).
In my example a Canadian Judge ordered the people who bought the book not to read it until it's official release however 1) This was in Canada lol and 2) It was 100% unenforceable and even if they could prove people disobeyed the order they couldn't do crap about it.
Original Leaker is the only one in the legal wrong here.
EDIT: Just talking law I understand why you guys don't want to allow it.

A stolen item is a stolen item no matter what. If you want to speak about law...it is always illegal to be in possession of a stolen item, no matter who stole it or even whether or not you knew it was obtained illegally. If a dvd player 'falls off the back of a truck' and you buy it, you don't get to keep it if they use the gps tracker to locate said dvd player. If someone shoplifts out the front door of Walmart, and hands it to you outside, you may as well had been the thief.
This all also applies to theft of intellectual property, which is what the images everyone is referring to are. They are the intellectual property of TLG and they are not for public distribution.

More hurtfully though, they can cut any ties they have with the website cutting off any chance the site may ever have of getting things like nice hi-rez images of the 'real sets' (when they're ready to show them) or even stop sponsoring a certain web-site's annual contest.

To all: Please no more arguing or debate or legal lessons about this anymore... it's always been one rule since the very beginning... don't post leaked pics. It doesn't matter who's breaking the law and who isn't... just don't post them, and if you see some, let us know so we can take them off.
CC works with TLG on things like this so that we can have a good relationship with the company, we don't want them to even consider suing us or our members for anything~

To clarify; I was talking about the "original leaker". It's possible to have access to the original LEGO source material without having signed NDAs. I wanted to point this out because Josh made it sound like every leak has a NDA-breaking source. It's not always like that. Yes... especially for my over-impatient one... I kind of miss the times when there was no Internet around (or, at least, I didn't know about it), and you would find out about the new sets only by reading the new catalogue, or by seeing them directly in a store. Don't you consider it to be like a spoiler? Like when you find out how a movie ends before actually watching it? Nah, we only have about a month before the sets start showing up at toy expos. While New York toy fair generally will show all the new products, there are other expos before NYTF that will get at least some of them.
